MINUTES OF THE MENDHAM TOWNSHIP COMMITTEE

 JULY 24, 2007

 

REGULAR MEETING

 

 

 

The Township Committee of the Township of Mendham , County of Morris , State of New Jersey , convened in Public Session on Monday, July 24, 2007 at 6:53 p.m. in the Mendham Township Hall, Brookside , New Jersey .

 

On call of the roll, the following Committee members were present:

Mrs. Schrier

                                    Mr.Cioppettini

                                    Mayor Florek

 

Absent:                       Mr. Phelan

 

Also Present:             Stephen Mountain , Township Administrator

                                    Penny Newell, Township Clerk

                                    Ann Carlson, Assistant Township Clerk

                                    Brent Carney, Esq.

 

Mayor Florek led all in the Pledge of Allegiance.

 

 

Mayor Florek introduced and read Resolution R2007-105, seconded by Mr. Schrier and carried by unanimous voice vote.

 

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY , AUTHORIZING DISCUSSION WITHOUT THE PRESENCE OF THE PUBLIC

 

WHEREAS, it is deemed appropriate that the Township committee discuss the matters hereafter mentioned without the presence of the public in accordance with the provisions of R.S. 10:412b, being section 7b of the Open Public Meetings Act;

 

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Mendham as follows:

Matters relating to:

 

  • Acquisition of Property
  • Contractual Issues EMS Construction Project
  • Keegan Update

 

The Township Committee convened in executive session at 6:55 p.m.

 

 

The meeting reconvened to Public Session at 7:41p.m.

 

 

Mayor Florek read the following notice:

 

“Adequate notice of this meeting of the Township Committee of the Township of Mendham was given as required by the Open Public Meetings Act as follows:  Notice was given to the Observer Tribune and the Daily Record on January 11, 2007, was posted on the Bulletin Board in the Township Offices and Notice was filed with the Township Clerk on January 11, 2007.

 

On motion of Mr. Schrier,  second of Mr. Krieg, the minutes of the Regular Session of July 29, 2007 were approved.  The roll call vote was unanimous.

 

OLD BUSINESS

 

There being no Old Business to discuss, Mr. Krieg moved to open the meeting to the public.  Mr. Schrier seconded.  All present voted yes.

 

HEARING PERSONS PRESENT

 

George Koenig, 13 Northgate Road , spoke of the new proposal by the State Agricultural Development committee to change the impervious coverage on farm property to 25% - ten times higher than currently allowed for buildings in Mendham Township .  Mr. Schrier noted that the County, too, is unhappy with this proposal.  He stated that the County was helpful in the Boonton Township decision to hold the standard to 4-5%.  Mr. Krieg questioned what reason there is for such high coverage.  Mr. Koenig said that this is being done to maximize the economic use of the land, turning farmland preservation into commercial ventures.  Mayor Florek asked Mr. Koenig to provide contacts so the Governing Body may

look into the matter more fully and have a better idea of what actually is going on.  Mr. Koenig agreed to forward the contacts.

 

There being no one else to be heard, on motion of Mr. Schrier, second of Mr. Krieg, the public portion of the meeting was closed.

 

 

NEW BUSINESS

 

Mayor Florek introduced Ordinance 211-2007 by title for first reading:

 

AN ORDINANCE CREATING A NEW ZONE DISTRICT, ENTITLED “THE RESIDENTIAL CLUSTER – RC ZONE”, WITH STANDARDS PERTINENT THERETO, AMENDING CHAPTER XXI “ZONING REGULATIONS” OF THE LAND USE ORDINANCE OF THE TOWNSHIP OF MENDHAM .

 

A short presentation by Sam Tolley, Vice Chairman of the Planning Board, and Dug Kimball, Planning Consultant, followed the introduction.  They gave background on this ordinance, explaining the unique conditions of this area of Mendham Township .  This ordinance, initiated by the Board of Adjustment recommendation to the Planning Board,  would put Master Plan recommendations on this area into effect.  The community had input into the ordinance and the new standards would reflect the character of the community and make life easier for those living there by reducing the need for Board of Adjustment applications.  The Ordinance also tried to allow for a modest amount of further improvements, including slightly larger homes and expanded homes.

 

Mr. Schrier made a motion to pass this ordinance on first reading.   Mr. Krieg seconded.  Upon a call of the roll, Ordinance 11-2007 was passed on first reading.  Mr. Mountain stated that second reading would be September 10, 2007, following  the next planning board meeting.

 

 

 

Jon Roth, Sam Tolley and Rich Steinberg appeared before the Governing Body to discuss two issues with the Emergency Services Building , the heating system and the floor.

Much discussion about the floor ensued, including the continuous need to paint the floor since the surface will crack under the constant pressure of heavy equipment; and especially about safety issues if the painted floor breaks down and oils and fluids permeate the concrete. The Governing

 

Body agreed to investigate the costs, contractor fees, etc. involved with changing the floor.  If this can be done, the Township will move to make the change. The Governing Body directed the Fire Company to obtain

quotes.  Mayor Florek  noted that there may be other unanticipated costs coming as the building progresses, so wise choices must be made.

 

Mr. Cioppettini brought up the second issue of the heating system and said that the issue has been of great concern, and the current plans are unacceptable.  He stated that the architect is addressing the concerns and he would like Fire Company input to make sure that the final drawings will be workable.  All agreed.

 

 

 

Mayor Florek offered Resolution R2007-106, extending the grace period for third quarter tax payments, for approval.

 

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY , REGARDING PAYMENT OF THIRD QUARTER 2007 PROPERTY TAX

 

Mr. Krieg moved to approve Resolution R2007-106; Mr. Schrier seconded.  All present voted yes.  Resolution R2007-106 is appended to the official minutes.

 

 

 

Mayor Florek offered Resolution R2007-107 for approval. 

 

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY , AUTHORIZING REFUND OF APPLICATION FEE

 

This resolution authorized the refund of a Board of Adjustment application fee.  The Governing Body had questions on the reasons for this refund and the resolution was tabled to the next meeting.  A copy of Resolution R2007-107 is appended to the official minutes.

Mayor Florek offered Resolution R-2007-108 for approval. 

 

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY, OPPOSING THE SALE OF STATE ASSETS

 

Mr. Schrier moved to approve Resolution R2007-108; Mr. Krieg seconded.  All present voted yes.  A copy of Resolution R2007-108 is appended to the official minutes.

 

 

Mayor Florek read a proclamation for the Kaleidoscope of Hope Foundation.  The proclamation is appended to the official minutes.

 

 

ADMINISTRATOR REPORT

 

Mr. Mountain reported on a meeting with  Morris County Dispatch to address problems that the Township has been experiencing since the change.  He was very pleased with the meeting and they have acknowledged there are problems to be addressed with  technical aspects of the systems, known and unknown.

 

Everyone at the meeting was satisfied with the action steps outlined and it is crucial to see that the steps and timeline are followed.

 

Mr. Mountain spoke of a memo received from the Environmental commission concerning ATV use at India Brook Park.  Several incidents have occurred.  Mr. Mountain recommended authorizing the Commission to purchase of a sign to emphasize that the park is for Pedestrian travel only. The Governing Body concurred.

 

Mr. Mountain said that the Open Space committee asked him to notify the Governing Body that the Committee is planning a promotional event for October 14 from 1 to 4 p.m.  Information will be coming on this event to promote open space – they will be reaching out to the Historic Preservation Committee, the Environmental Commission, Scout Groups, school, etc.

There was no discussion on the items presented.

 

There was no Legislative Report.

 

At this time Mayor Florek read a proclamation for retiring Township Clerk Penny Newell.  Mrs. Newell thanked the Governing Body and declared her extreme pleasure to have served the Township of Mendham for twenty years. The proclamation is appended to the official minutes. 

 

 

HEARING PERSONS PRESENT

 

Mr. Schrier moved to open the meeting to the public.  Mr. Krieg seconded, all voted yes.

 

Pat Zimmerman, West Main Street , Brookside ,  stated that she was pleased to hear that the Governing Body opposed the sale of state assets.  She also questioned  Resolution R2007-107,  and Mayor Florek explained that it is a refund of a Board of Adjustment application fee.  The resolution will be addressed at the meeting of August 13, 2007.

 

Marian Koste, 92 Ironia Road , thanked Mrs. Newell for her service to Mendham Township and stated she is the “perfect public servant.”

 

No one else came forward to be heard and Mr. Cioppettini moved to close the public portion of the meeting.  Mr. Krieg seconded and everyone voted yes.

 

At this time Mr. Schrier moved to re-convene into closed session.  Mr. Krieg seconded.  The meeting was closed to the public at 9:00 p.m.

 

The Committee returned to open session at 9:47 p.m.  Mr. Mountain stated that since the Governing Body expressed an interest in canceling one of the August meetings, that all business would need to be conducted at the August 13 meeting.  If there was a need for a special meeting, one would be called. further matters to come before the Committee, upon motion duly made and seconded, the meeting was adjourned at 9:47 p.m.
