MINUTES – MENDHAM TOWNSHIP COMMITTEE

Morris County , New Jersey

January 17, 2006

Mayor Krieg called the meeting to order at 5:15 p.m. in Township Hall, Brookside , New Jersey

ROLL CALL                           Present:         Mayor Krieg,  Mr. Pierson, Mr. Phelan,

                                                                        Mr. Schrier, Ms. Florek

                                                 Absent:

Also Present:          Christopher Falcon, Esq., Township Attorney

                                                                        Penny Newell, Township Clerk

SALUTE TO THE FLAG

Mayor Krieg read the following statement:

STATEMENT OF ADEQUATE NOTICE:  “Adequate notice of this meeting of the Township Committee of the Township of Mendham was given as required by the Open Public Meetings Act as follows:  Notice was given to the Observer Tribune and the Daily Record on January 15, 2006 ; Notice was posted on the bulletin board in Township Offices and Notice was filed with the Clerk on January 15, 2006 .”

Mr. Pierson stated that following the meeting of January 9th at which the Historic Preservation Ordinance was introduced upon first reading, he determined that he would probably change his vote at the second reading.  He said he is uncomfortable with a vote of 3-2 on such a controversial matter and he is also bothered by the inclusion of all houses 60+ years old.  He feels that truly historic houses, those dating to the late 1700’s and early 1800’s should be on Schedule A.

Mr. Pierson then made a motion to table Ordinance 2-2006; Ms. Florek seconded the motion.

ROLL CALL –  Ms. Florek, Mr. Pierson, Mr. Phelan, Mr. Schrier (reluctantly) and Mayor Krieg voted YES.

Mr. Schrier suggested that they review all the public commentary as part of the process in future reviews of this ordinance.  Mr. Phelan said it might be appropriate to put the ordinance on an agenda strictly as a discussion item rather than a draft ordinance and they should extensively publicize the dates for the discussions.

Upon motion duly made and seconded the meeting was opened to the public.

Nick Monahan, 20 W. Main Street :  thanked the Committee and said he is willing to take part in any future discussions of this issue.

Diane Weeks, 22 W. Main Street :  agrees with Mr. Monahan and suggested expanding the discussions to informal groups before bringing it to the public at a Township Committee meeting.

No others present asked to be heard.  Upon motion duly made and seconded the meeting was closed to the public.

With no further business to come before the Committee, upon motion duly made and seconded the meeting adjourned at 5:25 p.m.

Respectfully submitted:
