MINUTES OF THE TOWNSHIP OF MENDHAM PLANNING BOARD

REGULAR MEETING HELD AUGUST 7, 2006

 

 

Chairman Giordano called the meeting to order at 7:41 p.m. and asked for roll call.  Upon roll call: 

 

PRESENT:                  Mr. Pierson, Mr. D’Emidio Mrs. Link, Mr. Mountain, Mr. Johnson, Chairman Giordano

ABSENT:                     Mr. Tolley, Mayor Krieg

Others present:           Edward J. Buzak, Esq.

 

The Chairman led the flag salute and announced that adequate notice of the meeting had been given.

 

MINUTES

Motion to approve the Minutes of June 21, 2006, Work Shop meeting as amended, made by Mrs. Link, seconded by Mr. Mountain; all eligible to vote agreed. 

 

The Minutes of July 5, 2006, Work Shop meeting, were tabled for review by Attorney Buzak. 

 

APPLICATIONS

PB-06-02; TITTEL, Donn and Barbara; Minor Subdivision; Woodland Road ; Block 123, Lot  22; Anthony Wahl represented the applicant and said his letter of June 29, 2006 addressed the two requested variances.  Mr. Buzak said that the letter outlined the scope of the variances that would be used for the notice.  The July 18, 2006, Maser report, supported for the requested waivers except Nos. 8 and 11, which could be addressed during the course of the application.  The application proposed a subdivision with three existing cottages where only one half was located is in the township and no new construction.  Mr. Wahl said the Randolph subdivision was approved.  Previously they were concerned about access and had swapped land and converted a 50-foot wide strip easement to ownership.  Motion made by Mr. D’Emidio, seconded by Mr. Pierson to deem the application complete and grant the requested waivers as listed in Maser’s Report dated July 18, 2006.  Upon roll call vote: 

 

AYES:              Mr. Pierson, Mrs. Link, Mr. Mountain, Mr. D’Emidio, Mr. Johnson, Mr. Giordano

NAYES:           None

ABSENT:         Mr. Tolley, Mayor Krieg                       ABSTENTIONS:  None

Motion carried.  The application was scheduled for hearing on September 20, 2006. 

 

SCHIFF/BROOKRACE HOMEOWNERS ASSOCIATION; Mr. Buzak said the matter would be carried to the September 5, 2006 meeting to allow the Counselors recently obtained by the Muratore’s and Schiff to review the materials. 

 

DISCUSSION

Mr. Pierson was concerned about members of Woodland Lake coop jointly selling their property endangering the open space.  The Board requested Mr. Buzak and Mr. Kimball to discuss the matter and reply at the August 16, 2006, meeting. 

 

Mrs. Link said the DEP had responded to the letter submitted regarding the LOI on the wetlands located on the Millward property.  They had reviewed the classification and said it would not be reclassified as exceptional value. 

 

Mr. Buzak would contact Mr. Bisogno for an extension for the Cannavo/Simava application. 

 

The meeting was opened to the public, there being no comment, the meeting was closed to the public. 

 

Motion to adjourn the meeting at 8:48 p.m. made by Mr. Mountain, seconded by Mrs. Link; all agreed.
