RESOLUTION
PB-07-09 SIMAVA
(CANNAVO); Memorialize 90-Day Extension to File Subdivision Deed
Minor Subdivision (Block 130,
Lot
6)
Mr. Buzak began by saying
that this is a resolution memorializing the granting of an additional 90-day
extension to the applicant in order to perfect the minor subdivision that the
Planning Board granted late last year. There
were a number of conditions that had to be met.
The applicant was unable to meet all of them despite an effort by the end
of the first authorized time period. An
extension was granted initially, and when they were unable to meet the
conditions, another extension was sought. This
resolution grants them that second extension which expires on December 11, 2007.
Mr. Lemanowicz indicated
that the only outstanding item was the issue of the spring houses.
He said that Mr. Aubin produced a letter to the Board of Health, which
they have not responded to yet. This
should be pursued since there was some discussion as to what would be done with
the spring houses. He went on to say
that he, Mr. Aubin and Mr. Cannavo looked at the spring houses. The Board of
Health recommended that the two structures be filled with rocks or sand and
sealed with concrete. It wasn’t
appropriate based upon what Mr. Aubin saw from an environmental standpoint.
As a result, Mr. Aubin made a recommendation in his letter dated
September 27, 2007 and is waiting for the health department to respond.
