MINUTES – MENDHAM TOWNSHIP COMMITTEE Deputy Mayor Pierson called the meeting to order at ROLL CALL

COMMITTEE OF THE WHEREAS, it is deemed appropriate that the Township Committee discuss the matters hereafter mentioned without the presence of the public in accordance with the provisions of R.S. 10:412b, being section 7b of the Open Public Meetings Act.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Matters relating to: [X] personnel [X] contract negotiations [X] acquisition of property [X] litigation [X] attorney/client privilege
shall be discussed by the Township Committee without the presence of the public. It is anticipated that these matters can be disclosed to the public when further action is taken in connection with the discussion. Mr. Schrier made a motion to adopt R2005-111; Ms. Florek seconded the motion. ROLL CALL – All present voted YES. Upon motion duly made and seconded the Committee went into
closed session at Ernest DelGuercio was present to update the Committee regarding the reassessment and subsequent filing of tax appeals. Upon motion duly made and seconded the Committee returned
to open session at SALUTE TO THE FLAGDeputy Mayor Pierson read the following statement: STATEMENT OF ADEQUATE NOTICE: “Adequate notice of this meeting of the Township Committee of the Township of Mendham was given as required by the Open Public Meetings Act as follows: Notice was given to the Observer Tribune and the Daily Record on January 10, 2005; Notice was posted on the bulletin board in Township Offices and Notice was filed with the Clerk on January 10, 2005.” APPROVAL OF MINUTESOLD BUSINESS HEARING PERSONS PRESENT Upon motion duly made and seconded the meeting was opened to the public. No one present asked to be heard. Upon motion duly made and seconded the meeting was closed to the public. NEW BUSINESS 1. Resolution R2005-107 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE WHEREAS, with the appointment of Christopher Falcon, Esq. to the position of Township Attorney, a vacancy has been created in the position of Planning Board Attorney; and WHEREAS, Edward J. Buzak, Esq. has submitted his resume for consideration by the Township Committee; and WHEREAS, Mr. Buzak has met with members of the Township Committee as well as members of the Planning Board; and WHEREAS, it is the unanimous position of those who met with Mr. Buzak to appoint him to the position of Mendham Township Planning Board Attorney; NOW, THEREFORE, BE IT RESOLVED by
the Township Committee of the Ms. Florek made a motion to adopt R2005-107; Mr. Schrier seconded the motion. ROLL CALL – All present voted YES. 2. Resolution R2005-109 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE WHEREAS, appeals were filed with the State Tax Court by the owner of Lot 48.01 in Block 100 with regard to the 2003 and 2004 tax assessments against the property in the Township of Mendham. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, that the Treasurer be, and is hereby, directed to refund the following: Block 100

48.01 Mr. Pierson made a motion to adopt R2005-109; Ms. Florek seconded the motion. 3. Resolution R2005-110 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE WHEREAS, appeals were filed with the State Tax Court by the owner of Lot 27.07 in Block 100 with regard to the 2003 and 2004 tax assessments against the property in the Township of Mendham. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, that the Treasurer be, and is hereby, directed to refund the following: Block 100 27.07 Roger T. Mahan $43,281.02 State Tax Court Appeal/2004 100 27.07 Roger T. Mahan $37,239.75 State Tax Court Appeal/2003 Mr. Pierson made a motion to adopt R2005-110; Ms. Florek seconded the motion. ROLL CALL – All present voted YES. 5. Raffle Application RA128/Minutemen Sports Club was approved. 6. Request for permit fee refund: The Committee authorized the following resolution: RESOLUTON OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, AUTHORIZNG REFUND OF CONSTRUCTION PERMIT APPLICATION FEES
WHEREAS, the owners of WHEREAS, the permit application for the pool inadvertently included the cost of the fence, which was the subject of a separate permit application; and

Mr. Pierson made a motion to adopt R2005-108; Mr. Schrier seconded the motion. ROLL CALL – All present voted YES. ADMINISTRATOR REPORT 1. Mr. Mountain reported that the subcommittee for the Brookside Firehouse project will be meeting with architectural firms. 2. Mr. Mountain, along with Ross Johnson and Jon Roth, met with representatives from SSI regarding the emergency communications project. He said the FCC licenses have been received and a proposal will be presented at the first meeting in August for the implementation and upgraded coverage maps will also be provided. (Mr. Pierson left the meeting for a fire call) 3. Mr. Mountain
received a request from the Drakewick Homeowners’ Association for assistance
with a detention pond that has become overgrown with algae.
The Township currently maintains the pond and Mr. Mountain asked the
Committee if they would consider appropriating money in the 2006 capital budget
for an aerator. Mr. Schrier noted
that this has come before the Committee in the past and the pond is the
responsibility of the homeowners’ association.
Mr. Mountain will research the actually ownership of the pond and Mayor
Krieg suggested that if the Homeowners’ Association owns the pond the Township
should not maintain it. OPEN ITEMS LIST The Open Items List was reviewed and updated. Mayor Krieg suggested rescheduling the Historic

Mr. Pierson suggested looking into item #4. LEGISLATIVE REPORT APPROVAL OF BILL LIST The Township Committee approved the charges listed by department which list is attached hereto and made a part hereof. HEARING PERSONS PRESENT Upon motion duly made and seconded the meeting was opened to the public. Pat Zimmerman, No others present asked to be heard. to open session at The following resolutions were offered: Resolution R2005-112 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE WHEREAS, a need has arisen for a full time employee in the Department of Public Works; and WHEREAS, it is the recommendation of the Superintendent of the Department of Public Works that Stephan Holmes be hired as a full time employee in the Department of Public Works.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Mr. Schrier made a motion to adopt R2005-112; Ms. Florek seconded the motion. ROLL CALL – All present voted YES. Resolution R2005-113 RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE WHEREAS, on June 30, 2006 the New Jersey Transportation Trust Fund will have no capital funding available to provide local aid for transportation projects because all incoming revenue will be used for debt service payments; and WHEREAS, local governments have received approximately $2.0 billion from the Transportation Trust Fund and approximately $300 million in bridge bond funds; and $275 million in federal local road funds; and
WHEREAS, local roadways and bridges carry 55% of the traffic on country, municipal and state highways; and local governments maintain 32,810 centerline miles of roads, 2,498 major bridges and 4,584 minor bridges; and WHEREAS, a review of annual local transportation needs indicates $211 million for county bridges, $7.5 million for municipal bridges, $44 million for county roadways and $112 million for municipal roadways for a total of $374.5 million; and WHERESA, it is imperative that local governments receive a stable, dependable and long-term source of funding to actively maintain the State’s roadways and bridges; and WHEREAS, it is in the best interest of local governments to work in collaboration with the Governor of the State of New Jersey, the Commissioner of the New Jersey Department of Transportation and the New Jersey State Legislature to quantify the State’s transportation needs and pursue the appropriate methods of funding. NOW, THEREFORE, BE IT RESOLVED that the Township of Mendham hereby calls upon the Governor and the State Legislature to provide a stable, dependable and long-term source of funding to support the renewal of the New Jersey Transportation Trust Fund and an increase in the amount dedicated to local aid; and
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to the
Governor of the State of Ms. Florek made a motion to adopt R2005-113; Mr. Pierson seconded the motion. ROLL CALL – Mr. Pierson, Ms. Florek and Mayor Krieg voted YES. Mr. Schrier abstained. There being no additional matters to come before the
