Upon motion duly made and seconded the meeting was opened

NEW BUSINESS
1. Presentation – India Brook Park Master Plan –
Kathryn Porter, Brian Boden and Daryl Brewster were present. Mrs. Porter,
chairperson, presented the highlights of the plan, noting that recommendations
from their previous meeting with the Township Committee, as well as meetings
with neighbors to both India Brook and
Meadowood
Parks
, have been incorporated into the plan. Mrs. Porter said it is important to note
that these are master plans that include things that may be done immediately and
ideas for the future. She said the immediate need for India Brook Park is access
to the property, adequate parking and hiking trails. Mr. Brewster addressed the
needs for organized recreational activities such as baseball, soccer and lacross
fields. There was also some discussion about providing a park office in one of
the dwelling units at India Brook Park. Mr. Brewster also mentioned a “kennel
improvement plan” that addresses possible uses for the kennels and suggested
that a subcommittee work towards the best way to improve the kennel buildings
for recreational use that would comply with the green acres restrictions on the
property.
Mr. Mountain said Green Acres looked favorably on the site
for recreational purposes however they did have issues with the proposal to
lease out buildings to members of emergency services. The conflict is with
anyone not directly associated with maintenance and/or caretaker type
activities.

Mr. Brewster said they were looking at the kennel
improvements with the idea of approaching an organization such a the “Y” for
funding in order to minimize the cost to the taxpayers.
Mr. Phelan asked if the recommendations of the subcommittee
were based upon research of the number of children needing facilities. Mr.
D’Emidio said if would not be wise to duplicate facilities that may existing
in or are being planned for in nearby municipalities.
Mayor Pierson asked Mr. Brewster to provide projections for
growth within the next two weeks. Mr. Brewster will provide that information.
Mr. Phelan addressed the question of access to India Brook
Park because it has been noted that there are vacant buildings there and the
issue of security is vital. Mayor Pierson said he found some buildings open with
minor vandalism noted. He said it would be helpful to have a caretaker/tenant in
residence as soon as possible. Mr. Mountain said there are some employees of the
DPW that are interested. Mr. Mountain said one of the duties of a
caretaker/tenant would be to open and close the entrance to the park.
Mayor Pierson said exploring partnerships with other
agencies such at the YMCA may not provide a lot of money but would provide
advice and the Committee agreed to the subcommittee exploring such options.
Sarah Dean Link, a co-chair of the Environmental
Commission, said she is concerned that the Open Space Committee doesn’t know
what the Environmental Commission is doing with the trails. She referred to a
grant that is being used to build and improve trails and they have done some
work in India Brook Park. She said they also applied for a grant to put in a
bridge in the area between
Buttermilk
Falls
and India Brook Park.
Pat Zimmerman,
W. Main Street
, asked if the schools had been contacted to see if there is any room for
additional fields at either the elementary or middle school.
Mrs. Porter noted that the Environmental Commission has
developed trails in Meadowood and the Recreation Commission would like to study
the tennis court needs including the cost to rebuild the courts at Meadowood.
She also would like to know if the DPW could explore the possibility of
relocating their activities at Meadowood. Other future possibilities for
Meadowood include a group picnic area with a covered pavilion .
Mr. Mountain indicated that there is currently a capital
appropriation to cover the design and construction costs for the fields.
2. Resolution R2004-72

, AWARDING CONTRACT FOR THE MENDHAM EAST DISPOSAL BED PROJECT
WHEREAS,
bids were submitted to the Township for the Mendham East Disposal Bed Project;
and
WHEREAS,
on the basis of the bids received, the Township Administrator has recommended
that a contract be awarded to Brian Plushanski Construction Company, Inc.; and
WHEREAS,
the availability of funds for the payment of charges pursuant to the contract
hereby awarded has been certified by the Chief Financial Officer of the
Township; and
NOW,
THEREFORE, BE IT RESOLVED by the Township Committee of the
Township
of
Mendham
, in the
County
of
Morris
,
New Jersey
, as follows:
1.
A contract for the Mendham East
Disposal Bed Project in the amount of $993,915.00
is hereby awarded to Brian
Plushanski Construction Company.
2.
The Mayor is hereby authorized and
directed to execute a Contract between
the Township and Brian
Plushanski Construction Company. and the Township Clerk is hereby authorized and
directed to attest such contract and to affix the corporate seal thereto, and
when so executed and attested the contract shall be a valid and legally binding
contract of the Township in accordance with the terms thereof and the proper
officials of the Township are hereby authorized and directed to make and perform
any and all acts necessary to carry out such contract.
3.
Payment
by the Township to Brian Plushanski Construction Company
pursuant to the contract
authorized by this Resolution shall be from the following appropriation:

providing for the improvement of the sewer plant in and by the township of

including $100,000 available as a community development block grant and $450,000

Mr. Mountain reported that
the DEP permit is on the appropriate desk for signature and, in speaking with
the consultant, was assured that based on the status and verbal acceptance, it
is appropriate to award the contract noted in Resolution R2004-72. He said the
contractor is ready to begin as soon as the permit is issued. He also said that
if the permit process drags on for 4-6 weeks this project would be second in
line with the contractor. He also said that if there was no windfall by 2006
there is the possibility of a secondary rate increase to pay for the financing
cost of the project. Mr. Phelan emphasized that tax dollars are not being used
for this project. Mr. Krieg asked about a time frame to award the contract. Mr.
Mountain said if started this week, the project would be finished by the end of
September.
Mr. Schrier made a motion to
adopt R2004-72 subject to the receipt of the required DEP permits; Mr. Phelan
seconded the motion.

explained that this is a DEP requirement and presented the following resolution:

A RESOLUTION CONSENTING TO THE PROPOSED WATER QUALITY
MANAGEMENT (WQM) PLAN AMENDMENT ENTITLED:
CLYDE
POTTS WATER TREATMENT PLANT NJPDES NJ0098540
WHEREAS, the governing body of the
Township
of
Mendham
desires to provide for the orderly disposition of wastewater and reclaimed
water within the
Township
of
Mendham
; and
WHEREAS, the New Jersey Department of Environmental Protection (NJDEP)
requires that proposed wastewater treatment and conveyance facilities and
wastewater treatment service areas, as well as related subjects, be in
conformance with an approved WQM plan; and
WHEREAS, the NJDEP has established the WQM plan amendment procedure as
the method of incorporating unplanned facilities into a WQM plan; and
WHEREAS, a proposed WQM plan amendment noticed in the New Jersey Register
on
June 21, 2004
, for the Clyde Potts Water Treatment Plant NJPDES NJ0098540, has been prepared
by the New Jersey Department of Environmental Protection’s Division of
Watershed Management.
NOW, THEREFORE, BE IT RESOLVED, on this 14th day of June,
2004, by the governing body of the

Mendham
that:

hereby consents to the amendment entitled Clyde Potts Water Treatment Plant
NJPDES NJ0098540, and publicly noticed on
June 21, 2004
, prepared by the New Jersey Department of Environmental Protection’s Division
of Watershed Management, for the purpose of its incorporation into the
applicable WQM plan(s).
2.
This consent shall be submitted to the NJDEP in accordance with
N.J.A.C. 7:15-3.4.
Mr. Schrier made a motion to adopt R2004-80; Mr. Phelan
seconded the motion.

4. Discussion of Municipal Complex Site Plan – Mr.
Mountain said the architect would revise the plan preferred by the governing
body as well as the plan the architect himself preferred. The revisions will be
distributed prior to the next meeting for final review. Both Mr. Balut and Mr.
Aubin will also review the plans prior to submission to the DEP.
George McKinnell asked what other plan the architect wanted
to revise because he didn’t think the Township had agreed to pay for more than
one.
Sam Tolley said he didn’t like any of the concepts. He
said the parking accommodations are not adequately sited and he is concerned
with the ability to place additional bays on either side of the proposed
firehouse. Mr. Tolley asked about siting a septic system in a transition area.
Mr. Phelan noted that they can’t operate a new firehouse
until the old one is torn down and they must wait for the warm months for
construction.
There was some discussion about the number of bays and a
location for the antique engine. Mr. Phelan asked if the plan was to stay with
this architect throughout the entire process and Mayor Pierson replied only
through the site plan process. It was undecided whether to go out to bid for
just the building or the building and site plan. Mayor Pierson said this is all
based on the assumption that the Library is going to move. Mr. Phelan said
before they discuss the library the municipal need should be first and if the
library stays the needs of the municipal building are not going to be met. Mr.
Phelan said he didn’t foresee any problems with the plans assuming the library
moves.
5. Ordinance 14-2004 – First
Reading
ordinance vacating
the public rights in certain portions of glengary drive and indian hollow road
in the township of mendham
Mr. Schrier made a motion to adopt Ordinance 14-2004 upon
first reading with second reading and public hearing to be scheduled for
July 12, 2004

7. Resolution R2004-74
RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF
MENDHAM, PETITIONING MEMBERS OF THE MORRIS COUNTY LEGISLATIVE DELEGATION TO
INTRODUCE AND SPONSOR LEGISLATION CHANGING THE DATE OF ALL PRIMARY ELECTIONS IN
NEW JERSEY, AND ALL FIRE DISTRICT COMMISSION BOARD AND BUDGET ELECTIONS TO THE
THIRD TUESDAY AFTER THE FIRST MONDAY IN APRIL, TO COINCIDE WITH THE SCHOOL
BUDGET AND BOARD OF EDUCATION ELECTIONS
WHEREAS, the election for the Presidential Primary in
New Jersey
is the first Tuesday after the first Monday in June; and
WHEREAS, this late date effectively negates the impact of
New Jersey
voters on the results of the National Presidential Primary; and
WHEREAS, the election for school budgets and school boards of education
is the third Tuesday after the first Monday in April; and
WHEREAS, having the school budget and local boards of education election
alone on that date obscures its notice by many voters; and
WHEREAS, the election for members of the Fire District Commission Boards
and budget are held on the third Saturday in February; and
WHEREAS, some 80 municipalities in
New Jersey
hold municipal primaries on the second Tuesday after the first Monday in May;
and
WHEREAS, consolidating the dates of these four elections to the present
date in April for school budgets and boards of education would reduce the cost
to the taxpayers of having four separate election dates and would save the
taxpayers of New Jersey money; and
WHEREAS, having the Presidential Primary Election in April would enhance
the significance and impact of New Jersey’s vote in the National Elections;
and
WHEREAS, having primary elections on the same date as school budget and
board of education elections would draw more attention from the media and public
to the latter contests and would increase voter participation in both National
Primary Elections and School Board and School Budget elections; and
WHEREAS, all of the reasons set forth above provide sufficient
justification for the establishment of one uniform and consistent election date.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the

1. The governing body petitions the members of the Morris County
Legislative Delegation to introduce and sponsor legislation changing the date of
all primary elections in New Jersey and all Fire District Commission Board and
budget elections to the third Tuesday after the first Monday in April, to
coincide with the school budget and board of education elections.
2. That a certified copy of this resolution shall be transmitted to the
members of the Morris County Legislative Delegation, the President of the
Senate, the Speaker of the General Assembly, Governor James E. McGreevey, the
Morris County Board of Chosen Freeholders and the New Jersey State League of
Municipalities.
Mr. Schrier made a motion to adopt R2004-74; Mr. Krieg

8. Resolution 2004-75
A RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF
MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, PETITIONING MEMBERS OF THE MORRIS
COUNTY LEGISLATIVE DELEGATION TO INTRODU E AND SPONSOR LEGISLATION TRANSFERRING
THE LOCAL GOVERNMENT EMPLOYER’S SHARE OF THE PFRS AND PERS PENSION RETIREMENT
SYSTEM COSTS TO STATE GOVERNMENT SO THAT IT IS CONSISTENT WITH THE EDUCATIONAL
PENSION SYSTEM PROGRAM
WHEREAS, on
July 1, 2003
, P.L. 2003 Chapter 108 was enacted; and
WHEREAS, the aforesaid legislation shifts the employers’ share of the
cost of retirement for enlistees in the PERS and PFRS system to local
government, starting with 20% of the PFRS share in 2004 and rising
incrementally, year by year, to 100% of the share in 2008, and 20% of the PERS
share in 2005 and rising incrementally year by year to 100% in 2009; and
WHEREAS, previously, this expense was born by the state through excess
assets in the pension funds; and
WHEREAS, transferal of said costs to local governments would constitute a
significant fiscal expense which may only be offset by an increase in the
already excessive property tax burden of local residents; and
WHEREAS, the State of New Jersey has available to it additional funding
sources, not available to local governments, to offset the employer share of the
retirement system costs; and
WHEREAS, PERS and PFRS are State administered and regulated pension
retirement systems over which local government has extremely limited control;
and
WHEREAS, the State of New Jersey covers the employer’s share of the
Educational System Pension Program; and
WHEREAS, the governing body of the Township of Mendham believes that
consistent with State policy in covering the employer share for retirees through
the Educational System Pension Program, that the State of New Jersey assume the
PFRS and PERS employer share of pension retirement system costs.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Mendham, in the County of Morris, New Jersey, as follows:
1. That the governing body petitions members of the Morris County
Legislative Delegation to introduce and sponsor legislation transferring the
local government employer’s share of the PFRS and PERS pension retirement
system costs to the State government so that it is consistent with the Education
System Pension Program.
2. That a certified copy of this resolution shall be transmitted to the
members of the Morris County Legislative Delegation, the President of the
Senate, the Speaker of the General Assembly, Governor James E. McGreevey, the
Morris County Board of Chosen Freeholders and the New Jersey State League of
Municipalities.

ADMINISTRATOR REPORT
1. Mr. Mountain reported on two bridge projects: the East
Main Street project will start July 5th and the road closing portion
of the project will end by September 6th. He pointed out that there
is no room for delay but will advise the Board of Education to prepare a
contingent plan for school buses. He also noted that water lines will be moved
and he will notify fire and first aid. The Mosle Road project is in the
preliminary engineering stage and the County is working with the Historic
Preservation Committee to find an historic and aesthetic design that is
acceptable. This project will require a seven month closure of Mosle Road and is
scheduled for the summer of 2005.
2. Mr. Mountain reported that the Hope Bible Mission is
interested in selling their property and he has referred them to the Morris
County Park Commission to explore their interest in acquiring some frontage for
the Patriot’s Path connection to the Clyde Potts/Randolph portion.
Mayor Pierson noted the letter from Morris County regarding
the amendments to County Standards that now require digital submissions to the
County Planning Board. He said he would like to see the Township have a similar
requirement.
Mr. D’Emidio asked for clarification of a Verizon bill
for two pay phones. It had been previously been reported that the pay phone is
Township Hall was going to be removed.
Mr. Phelan asked about the status of the Knollwood Trail
area drainage/water problem. Mr. Mountain said the engineer’s report will be
available for the first meeting in July and he will notify the resident who
expressed concern.

LEGISLATIVE REPORT
Mayor Pierson recommended the following resolution for
consideration:
RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF
MENDHAM,, URGING MEMBERS OF THE MORRIS COUNTY LEGISLATIVE DELEGATION TO OPPOSE
ASSEMBLY BILL 2073 AND SENATE BILL 1559
WHEREAS, A-2073/S-1558 goes far beyond its intent to address violations
of rights protected under the New Jersey Constitution; and
WHEREAS, A-2073/S-1558 specifically includes a provision for award of
counsel fees to a prevailing plaintiff for any claim that arises from an alleged
violation of “any rights, privileges or immunities secured by the constitution
or laws of this state”; and
WHEREAS, this could inevitably encourage litigation arising under a hose
of statutory provisions; and
WHEREAS, the working in A-2073/S-1558 could allow an award of counsel
fees for any case brought against a governmental entity arising under any
statutory provision if the plaintiff can allege denial of due process; and
WHEREAS, this could potentially include such an allegation in an
appeal from a Planning Board or a Zoning Board of Adjustment, and if the
plaintiff prevailed on that argument, he or she could then seek to recover
counsel fees; and
WHEREAS, this bill could apply to appeals where someone was denied a
license, denied a construction permit, filed an appeal to the construction board
of appeals, or had disciplinary action taken against a license (alcoholic
beverage licenses, etc.), and could also apply to every grievance hearing
conducted by the local government under collective bargaining contracts,
disciplinary actions against employees, and the like; and
WHEREAS, this legislation would enable employees who routinely claim they
did not receive a fair hearing at the local level to bring suit for the
deprivation of due process, thereby significantly increasing the costs of the
disciplinary cases and putting pressure on management to ignore conduct that is
unacceptable on the part of an employee; and it could also apply to cases
arising in the schools as the result of disciplinary hearings involving students
or employees, decisions involving classifications of students, etc.; and
WHEREAS, suits for tort damages that have nothing to do with
constitutional or civil right issues could be brought under this statute to
avoid the carefully crafted immunities of the Tort Claims Act; and
WHEREAS, there is no corresponding right to obtain counsel fees if the
governmental entity were to prevail, however, the plaintiff need only prevail in
the litigation to receive counsel fees; and
WHEREAS, the potential for awards of counsel fees in such actions is
enormous; and
WHEREAS, this legislation carries no statute of limitations or language
to make it prospective in application, meaning it could apply to claims already
filed and in litigation; and
WHEREAS, the consequences for municipalities and their overburdened
taxpayers could be horrendous; and
WHEREAS, the Municipal Excess Liability Joint Insurance Fund has
estimated that the cost of this legislation to municipalities could easily be
$25 to $50 million per year or more.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Mendham, to strongly oppose A-2073/S-1558 and they urge its defeat in its
current form; and
BE IT FURTHER RESOLVED by the Township Committee of the Township of
Mendham to urge support of amendments to address these serious concerns so that
there can be protection for the civil rights of New Jersey citizens without
opening the floodgates to litigation on a broad range of claims that will no
longer be governed by the traditional principle that litigants pay their own
costs of litigation.
BE IT FUTHER RESOLVED that copies of this Resolution be forwarded to the
members of the Morris County Legislative Delegation, Governor James E. McGreevey
and to the New Jersey State League of Municipalities.
Mr. Schrier made a motion to adopt this Resolution
(R2004-81); Mr. Krieg seconded the motion.

APPROVAL OF BILL LIST

HEARING PERSONS PRESENT
Upon motion duly made and seconded the meeting was opened
to the public.
Diana Orban Brown, Ironia Road: said she supports the
Township’s efforts to preserve open space and is proud of the Township
Committee for raising the issue of needs vs. wants. She also suggested that the
India Brook Park and Meadowood Park subcommittee consider asking someone from
Ironia Road and/or Old Mill Road to join their group as they get into the
details of the projects. She volunteered to serve as a resident of Ironia Road.
Mayor Pierson replied that he would pass the suggestion on the Mrs. Porter and
would be happy to recommend Ms. Brown for the subcommittee. Mr. Schrier added
that it may not be wise to disrupt the membership of the subcommittee, noting
that anyone can sit in on the meetings.
Chief Costanza, Mendham Township Police: referred to the
municipal site plan and reminded the Committee that the police department
instituted the need for a building in 1994 and 10 years later it appears that
the need for a new firehouse is driving the project with no input from the
police department being solicited. He said that if the site plan is going to
include a new headquarters, the police department should be given an opportunity
to comment. Mr. Phelan said the police department will be given an opportunity
to comment and Mayor Pierson said much depends on future meetings with the
Borough relative to a merger of the two police departments. Mr. Schrier said the
facilities needs haven’t changed very much since the early 1990’s.
Sarah Dean Link, Tingley Road; said the meetings of the
India Brook Park and Meadowood Park subcommittee are generally ad hoc and not
well known to the general public. She supports involvement from residents near
the two areas.
There being no others present who asked to be heard, upon
motion duly made and seconded the meeting was closed to the public.
Upon motion duly made and seconded the Committee went into
closed session at 10:08 p.m.
Chief Costanza’s recommendations for police department
secretarial personnel were addressed. Personnel issues, Green Acres regulations
pertaining to the leasing of properties in India Brook Park, the cell tower
litigation and potential acquisition of property were other matters discussed by
the Committee.

R2004-77
RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF
MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, APPOINTING EMPLOYEE IN THE MENDHAM
TOWNSHIP POLICE DEPARTMENT
WHEREAS, a need has arisen for a full time secretary in the Mendham
Township Police Department; and
WHEREAS, Candace Alderton has applied for the position and the Chief of
Police has recommended the appointment of Candace Alderton to the full time
position of secretary in the Mendham Township Police Department.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Mendham, in the County of Morris, that Candace Alderton be appointed to the
position of full time secretary in the Mendham Township Police Department at an
annual salary of $32,500 effective June 14, 2004. For purposes of calculating
vacation and sick leave, Candace Alderton’s start date will be April 24, 1995
to reflect her years of part time employment with the Township.

WHEREAS, Lou Ann Finlay has applied for the position and the Chief of
Police has recommended the appointment of Lou Ann Finlay to the part time
position of secretary in the Mendham Township Police Department.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Mendham, in the County of Morris, that Lou Ann Finley be appointed to the
part time position of secretary in the Mendham Township Police Department at an
hourly salary of $12.50 effective June 14, 2004.

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF
MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, APPOINTING EMPLOYEE IN THE MENDHAM
TOWNSHIP POLICE DEPARTMENT
WHEREAS, a need has arisen for a matron in the Mendham Township Police
Department; and
WHEREAS, Lisa Pedalino has applied for the position and the Chief of
Police has recommended the appointment of Lisa Pedalino to the position of
matron in the Mendham Township Police Department.
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township
of Mendham, in the County of Morris, that Lisa Pedalino be appointed to the
position of matron in the Mendham Township Police Department at the hourly rate
of
$14.85 at a minimum of four hours per call out effective
June 14, 2004.
Mr. Schrier made a motion to adopt R2004-77, R2004-78 and
R2004-79; Mr. Phelan seconded the motion.
