MINUTES – MENDHAM TOWNSHIP COMMITTEE

Mayor Pierson called the meeting to order at 7:30 p.m. in Township Hall, Brookside , New Jersey

Mayor Pierson read the following statement:

STATEMENT OF ADEQUATE NOTICE:  “Adequate notice of this meeting of the Township Committee of the Township of Mendham was given as required by the Open Public Meetings Act as follows:  Notice was given to the Observer Tribune and the Daily Record on January 15, 2004; Notice was posted on the bulletin board in Township Offices and Notice was filed with the Clerk on January 15, 2004 .”

APPROVAL OF MINUTES  - October 12, 2004 – Mr. Schrier made a motion to approve these minutes as written;  Mr. Krieg seconded the motion.   ROLL CALL – All present voted YES.

OLD BUSINESS

1.  Mayor Pierson announced that the Supreme Court would be announcing their decision on the cell tower case tomorrow at 10:00 a.m.

2.  Ordinance 18-2004 – First Reading (readoption)

BOND ORDINANCE PROVIDING A SUPPLEMENTAL APPROPRIATION OF $130,000 FOR PRELIMINARY PLANNING AND DESIGN OF THE BROOKSIDE FIREHOUSE AND MUNICIPAL COMPLEX SITE PLAN IN AND BY THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY AND AUTHORIZING THE ISSUANCE OF $123,500 BONDS OR NOTES OF THE TOWNSHIP FOR FINANCING PART OF THE APPROPRIATION.

Mr. Krieg made a motion to adopt Ordinance 18-2004 upon first reading with second reading and public hearing to be scheduled for November 8, 2004 ;  Mr. D’Emidio seconded the motion.

ROLL CALL – All present voted YES.

A copy of Ordinance 18-2004 is attached hereto and made a part hereof.

HEARING PERSONS PRESENT

Upon motion duly made and seconded the meeting was opened to the public.

Frank Mulcahy, 7 Knollwood Trail East:  referred to a previous discussion regarding noise regulations for power equipment.  Mayor Pierson indicated that this subject would be addressed later in the meeting and Mr. Mulcahy would have an opportunity to speak about it at that time.

NEW BUSINESS

1.  R2004-118

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM , IN THE COUNTY OF MORRIS , NEW JERSEY , APPOINTING NICHOLAS PRUMATICO AS A PROBATIONARY OFFICER IN THE MENDHAM TOWNSHIP POLICE DEPARTMENT

            WHEREAS, the Chief of Police of the Mendham Township Police Department has recommended that Nicholas Prumatico be employed as a Probationary Officer in the Mendham Township Police Department; and

                        WHEREAS, the Township Committee has determined that Nicholas Prumatico possesses the necessary qualifications for employment as a Probationary Police Officer in the Mendham Township Police Department.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham , in the County of Morris , New Jersey , as follows:

1.      Nicholas Prumatico is hereby employed as a Probationary Officer of the Mendham Township Police Department as of October  26, 2004 .

2.      During 2004 Nicholas Prumatico shall be compensated at the salary rate provided in the 2001/2004 Agreement between the Township of Mendham and the Mendham Township Police Bargaining Unit , namely, at the rate of $40,414.00  Pursuant to Article XIII of the Agreement Patrolman Prumatico’s Holiday pay is included in the base salary.

3.      The employment of Nicholas Prumatico as a Probationary Officer is pursuant to the provisions of the Revised General Ordinances of the Township of Mendham, 1998, as amended and supplemented and the 2001/2004 Agreement between the Township of Mendham and the Mendham Township Police Bargaining Unit, and accordingly, unless sooner terminated by action of the Township Committee, such employment shall automatically terminate on October 26, 2005.  In any event Nicholas Prumatico shall not be an employee of the Township of Mendham after October 26, 2005 unless he shall be appointed by the Township Committee as a permanent member of the Mendham Township Police Department.

4.      In the event that Nicholas Prumatico shall be appointed as a permanent member of the Mendham Township Police Department after the satisfactory completion of a one-year probationary period, then for purposes of calculating salaries, vacations and longevity benefits to which he will be entitled as a permanent member of the Mendham Township Police Department the date of commencement of his service under the provisions of the 2001/2004 Agreement between the Township of Mendham and the Mendham Township Police Bargaining Unit and successor Agreements shall be October 26, 2004.

5.      Certified copies of this Resolution shall be forwarded by the Township Clerk to the Chief of Police and to Nicholas Prumatico.

6.      A certified copy of this Resolution shall be endorsed by Nicholas Prumatico to indicate his acceptance of the terms and conditions of his employment, and such endorsed certified copy shall be filed with the Township Clerk.  This Resolution shall become null and void in its entirety if such endorsement and filing are not accomplished by November 2, 2004 .

Mr. Phelan made a motion to adopt R2004-118; Mr. Schrier seconded the motion.

2.  Environmental Commission and Tree Protection Committee/Monitoring of Easement and Woodlots.

Sarah Dean Link represented the Environmental Commission and Brian Hays represented the Tree Protection Committee.

Mr. Hays began with a brief explanation of proposed work to be done during the end of this year and into next year.   He noted that Township ordinances address tree removal on both undeveloped and developed property.  He said that forest management plans have been monitored from a county and/or state level and by involvement of the Tax Assessor at the local level.  He said that the tree committee met with the environmental commission and the Township forester to discuss the current forest management plans on file with the Township. He noted that the state takes 5 years to look at forest management plans. A major concern relates to a current plan that was approved in the past.  He said that there are questions about 2 of the 32 current plans.  The proposal includes a request for funding to begin reviewing the plans with concentration on water quality issues.  Mr. Schrier asked about the tax assessment standards that must be met in order for a property to be assessed as woodland and/or farmland.   Mr. Hays said that the tax assessor doesn’t review the properties to see if they are being maintained to accepted management state standards.  The proposal being presented here would give the Township a better assessment of whether the properties are being maintained to the accepted standards.  Mr. Krieg asked what amount of income has to be generated to obtain woodland status.  Mr. Hays said $500 is the minimum.  Mr. Hays said that with different people managing the plans a variety of standards are used. 

Sarah Dean Link said the Environmental Commission inventoried conservation easements five years ago and now their next step will be to educate the property owners regarding what can and cannot be done on easements as well as to set up a monitoring program.  She said their plan is to hire the Township’s forester to do the inspections of easements over the winter and early spring, with no commitment beyond the baseline inspection proposed.

3.  Mayor Pierson, assisted by Chief Costanza, administered the Oath of Office to Patrolman Prumatico.  Patrolman Prumatico’s mother, Frances, held the Bible for her son.

4.  Ordinance 20-2004 – First Reading

ordinance regulating hours of construction and use of power equipment and supplementing the mendham township ordinance code with a new section 3-9

Mr. Clapp explained that this ordinance is not a regulation of noise; to do that requires a decibel reading machine.  The current ordinance addresses construction by contractors and homeowners.  Mr. Schrier asked for the phrase “peace and tranquility” to be added to 3-9.1.   There was a lengthy discussion regarding the use of “family members” vs  “relatives” in 3-9.3.  Mr. D’Emidio said he has a problem with the 5:00 p.m. ending time on Saturdays. 

Mayor Pierson opened the discussion, on this topic only, to the public.

Frank Mulcahy, 7 Knollwood Trail East: thanked the Township Committee for moving so quickly on this matter.  He said his concern is policing these regulations and he acknowledged that the police won’t be going around with a stopwatch looking for someone mowing their lawn at the wrong time, but would respond only in the event of an actual complaint.

Phyllis Florek, Prudence Lane :  asked about how these regulations will impact snow removal.  Mayor Pierson explained that snow removal activities are exempt from these regulations.

Marian Koste, Ironia Road :  said this is a touchy subject to address, but it does address a quality of life and concern for neighbors issue.  She noted that barking dogs left outside for long periods of time and large equipment owned and operated by homeowners are also concerns.  She said that once one has complained to a neighbor about such things, one is labeled as a troublemaker.    Mr. Schrier replied to Ms. Koste, noting that there is a neighborhood dispute resolution committee to deal with such matters.  He said this proposed ordinance is meant to help people understand that some activities do intrude on one’s neighbor’s quality of life.  Mrs. Koste said she appreciates the shorter timeframes and suggested education of the public will be needed.  Mayor Pierson said there will be a press release in addition to the official publication of the ordinance prior to final reading.

No others asked to be heard.  Upon motion duly made and seconded the meeting was closed to the public.

Mr. Schrier asked if the ordinance contained an exemption for farming activities.  Mr. Clapp said it does contain an exemption.

Mr. Krieg said he has had conversations with several landscapers and they have been supportive of the proposed regulations.

Mr. Phelan said he is comfortable with the proposed starting times, and he could be persuaded to approve either 5:00 or 6:00 p.m. for ending times on weekends and holidays.

Mr. D’Emidio said he is weighing the positives and negatives of the suggested times and his earlier concerns about the ending times on weekends are waning.  Mr. Krieg said 6:00 pm would be acceptable.

Mr. Schrier made a motion to adopt Ordinance 20-2004 with the suggested changes; Mr. Krieg seconded the motion.

5.  Discussion of Request for Waiver/Conservation Easement at 128 Mosle Road.   Michael Keegan and Richard Traynor, Esq., were present for the discussion.

Mayor Pierson acknowledged receipt of a letter from Mr. Keegan following the discussion of this matter at the October 12th Township Committee meeting.  Mayor Pierson asked Mr. Keegan if he had written the letter himself.  Mr. Keegan said he had not but had approved it.  Mayor Pierson said he looked at the property and he remembered it as being in a natural state.  He said it now looks as if something had been done to it.  He then researched the matter and found that a zoning violation had been issued in October 2003.  Mr. Keegan said he was told it was for the removal of trees within the easement.  Mayor Pierson asked Mr. Keegan if he had planted the evergreen trees that are in the easement.   Mr. Keegan said he did plant the trees as he was unaware of any restrictions on planting trees on an easement.  Mr. Clapp said there is nothing in the easement language that prevents planting.

Mayor Pierson said  the Township Committee has discretion and this is the first such request they received.

Mr. Krieg said he looked at the property without actually going up the driveway because there was a dog there and he didn’t want to get it barking.  He said he noticed a wire fence with wooden posts that looked like a deer fence and it appears to be in the easement.  Mr. Keegan acknowledged the fence is in the easement by about 20’ into the 50’ easement.  Mr. Krieg asked what the dimensions of the proposed fence and posts.  Mr. Keegan said the posts are 2’x2’x6’ concrete posts. 

Mr. D’Emidio said he was unable to look at the property, however, he said he is not really hearing a good reason to put the fence in the easement.  He said fences don’t have to be in a straight line.

Mr. Keegan said he is trying to stay away from the trees.   Mr. D’Emidio said he may not be able to avoid some trees on the property. Mayor Pierson said there is a mesh fence on top of a weathered fence at his property that Mr. Keegan may want to take a look at.

Mr. Schrier said he is irked at the tone of the letter due to the threatening tone that either this proposal be approved or trees will come down.  Mr. Keegan said it is likely that some trees will have to come down in order to put the fence outside of the easement.   Mr. Schrier asked Mr. Keegan if he would consider alternatives to his proposed style of fence.  Mr. Keegan said he would be willing to look at alternative fencing, he just wants to keep deer off his property.

Mayor Pierson said he is sympathetic to Mr. Keegan’s problem.

Mr. Phelan said he was not at the last meeting and was unaware of the discussion of this matter.  He didn’t visit the property, however, he has seen the exhibits and photos.  He suggested that, with some creative landscaping, the objective of keeping the fence outside the easement area may be achievable.

Sarah Dean Link reported that the Environmental Commission discussed this matter at their last meeting and had not seen Mr. Keegan’s letter or proposal.  She noted that a conservation deed language specifically prohibits fences in easements with no provision for waivers from the Township Committee.  It was clarified that the easement on Mr. Keegan’s property was written prior to the language referred to by Mrs. Link becoming part of the Land Use Ordinance of the Township. 

Mr. Traynor asked what  would be the negative impact of allowing a fence in an easement.  Mayor Pierson replied that the Township prides itself on maintaining open space and its rural   character.  Mr. Traynor said the property in question would still suit those purposes.

Mr. Keegan said he would consider a different type of fence if his proposed location was approved.

Mr. Schrier said more time is needed to make any decision on this request.  Mr. Traynor said the burden of proof is on the applicant in planning board and board of adjustment applications and this case is different and if the committee finds any reason that the fence should be allowed that should be good enough.   Mr. Clapp said he disagrees; he said that because the easement refers to an exception that doesn’t mean it has to be granted.

Mayor Pierson asked Mr. Keegan if he is willing to wait until Mr. D’Emidio, Mr. Phelan and Mr. Schrier  have had a chance to visit the property.  Mr. Keegan asked how that would benefit his case.  Mr. Schrier said the point is that the Township Committee is trying to protect the easement and have changed the form of language for an easement to prohibit fences.  He said the easement belongs to the municipality and they want to protect it.

Mayor Pierson said it is Mr. Keegan’s choice to wait until the members of the Committee have seen the property.  He said unless a hardship can be demonstrated he would not be in favor of granting the request.

Mr. D’Emidio said he would have to go to the site and if something jumps out at him he would consider going onto the easement.

Mr. Traynor said it is possible to put the fence outside the easement area with or without removing trees but to put it inside the easement area would require the removal of some trees.

Mr. Keegan said if there is a possibility of getting the waiver he would be willing to wait another two weeks. 

Mayor Pierson said this would be deferred to the next meeting and the three members of the Township Committee that have not visited the property will do so prior to that meeting.

6.  Resolution R2004-119

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, AUTHORIZING DISCUSSION WITHOUT THE PRESENCE OF THE PUBLIC

            WHEREAS, it is deemed appropriate that the Township Committee discuss the matters hereafter mentioned without the presence of the public in accordance with the provisions of R.S. 10:412b, being section 7b of the Open Public Meetings Act.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, as follows:

Matters relating to:

  [X]  attorney/client privilege 

             

shall be discussed by the Township Committee without the presence of the public.  It is anticipated that these matters can be disclosed to the public when further action is taken in connection with the discussion.

Mr. D’Emidio made a motion to adopt R2004-119; Mr. Krieg seconded the motion.

7.  Resolution R2004-120

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, AUTHORIZING EXECUTION OF DEVELOPER’S AGREEMENT FOR SAJ ASSOCIATES, LLC

            WHEREAS, by Resolution PB-04-12 adopted on August 18, 2004, the Planning Board of the Township of Mendham granted final subdivision approval for the development of Lot 35 in Block 123 by SAJ Associates, LLC; and

            WHEREAS, the aforesaid Resolution requires the execution of a Development Agreement and the furnishing of a performance guarantee to the Township; and

            WHEREAS, the Township Attorney has reviewed and approved the following document:

            SAJ Developer’s Agreement, a copy of which is marked Appendix A and attached to this Resolution.

                        WHEREAS, the governing body of the Township is satisfied with the foregoing document.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, as follows:

1.      The Mayor is hereby authorized and directed to execute the SAJ Associates, LLC Development Agreement in the form of Appendix A and the Township Clerk is hereby authorized and directed to attest such Agreement and to affix the municipal seal thereto, and when so executed and attested the Agreement shall be a valid and legally binding obligation of the Township in accordance with the terms thereof, and the proper officials of the Township are hereby authorized and directed to make and perform any and all acts necessary to carry out such Agreement. 

2.      This Resolution shall take effect upon adoption.

Mr. D’Emidio made a motion to adopt R2004-120; Mr. Schrier seconded the motion.

8.  Resolution R2004-121

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, AUTHORIZING THE RELEASE OF SAJ ASSOCIATES, LLC PERFORMANCE BOND POSTED IN CONNECTION WITH THE LOOK SUBDIVISION

            WHEREAS, SAJ Associates, LLC posted a performance bond in connection with the Look Subdivision; and

            WHEREAS, Resolution 98-172 adopted by the Township Committee on November 24, 1998 authorized the reduction of that performance bond from $23,823.60 to $6,276.00; and

            WHEREAS, the Township Engineer has confirmed that the subdivision improvements have been satisfactorily completed and the two-year maintenance period has been met.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, that the above noted performance bond (Escrow Account #21009) is to be released following payment of final inspection fee invoices from the Township Engineer.

Mr. D’Emidio made a motion to adopt R2004-121; Mr. Krieg seconded the motion.

9.  Resolution R2004-122

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, TO AMEND THE 2004

BUDGET

            WHEREAS, N.J.S. 40A4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and

            WHEREAS, said Director may also approve the insertion of an item of appropriation for an equal amount; and

            WHEREAS, the Township has received $1,000 from the Department of Community Affairs Domestic Violence Training Program and wishes to amend its 2004 Budget to include the full amounts as revenue.

            NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the Township of Mendham, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2004 in the sum of $1,000 which is now available as  revenue from:

            Miscellaneous Revenues

              Special Items of General Revenue Anticipated with Prior Written Consent

              Of the Director of Local Government Services:

                State and Federal Revenues Off-set with Appropriations:

                        Domestic Violence Training Program

            BE IT FURTHER RESOLVED that like sum of $1,000 be and the same is hereby appropriated under the caption of:

Mr. Krieg made a motion to adopt R2004-122; Mr. Phelan seconded the motion.

10.  Roy Levine was recognized as a member of Ralston Engine Company No. 1.

ADMINISTRATOR REPORT

1.  Mr. Mountain discussed the diversion application that he is preparing to submit to the Green Acres Program.  The application requests removal of apartments at India Brook Park  from the Green Acre regulations to allow rental by members of the Township’s emergency service personnel.   A contribution equal to the value of the section of the building containing the apartments has to be made from the general fund to the open space trust as part of the Green Acres diversion process if approved.  That funding must be used to acquire open space within two years from the diversion approval.

Mr. Phelan asked about a timeframe for opening the gate at India Brook Park.  Mr. Mountain said it would remain closed until a steward is on site.

2.  Mr. Mountain said the final concept design for the firehouse site plan has been received and it addresses the concerns expressed by the Township Engineer and Committee.  He said the firehouse location remains the same and the traffic flow and parking has been revised.  He plans to go ahead with the process of hiring an architect and obtaining DEP permits. He said additions to Township Hall and putting a new Police Headquarters on the footprint of the existing building would not involve the DEP.

Mr. Phelan said the site plan has been amended to accommodate the needs of the community by addressing the Firehouse needs, the functionality of Township Hall and expanding Police Headquarters to a 2-3 story building in its current location without DEP involvement. 

Mayor Pierson reported that he, along with Mr. Phelan and Mr. Mountain, met with Mendham Borough representatives and all agreed there is no further interest on the part of the Borough in the consolidation of the two police departments.  Mr. Phelan said that no data was ever collected to confirm whether assessments of the situation used by the Borough were accurate.  He said it is very disappointing but suggested concluding on a positive note by looking at the efforts on behalf of a joint library, municipal court, recreation and sharing of equipment.

Mr. Schrier shared comments made by a retiring member of the Chester Borough Council that said there should be one Chester not two Chesters.   He also said it seemed unfortunate that one of the reasons for Mendham Borough to not want to go forward was because of the sentiment of the members of their police department.   Mayor Pierson it was shameful that it came to that.

Mr. Phelan asked about the lights that have been installed at the SMCMUA plant at the reservoir.  Mr. Mountain said a violation notice was sent today.

LEGISLATIVE REPORT

Mr. Mountain noted an article in the Star Ledger regarding the expansion of the right to farm regulations to include such uses as cell towers and other commercial uses which could turn farms into commercial districts.

APPROVAL OF BILL LIST

The Township Committee approved the charges listed by department which list is attached hereto and made a part hereof.

Marian Koste, Ironia Road:  said she obtained a copy of the bill to expand approved uses under the right to farm regulations and it does not include farm assessed properties.  She cautioned the Committee to stay on top of this issue and to be open to re-zoning.  

Sarah Dean Link, Tingley Road: suggested moving the India Brook Park gate further away from  Ironia Road.

No one else present asked to be heard.  Upon motion duly made and seconded the meeting was closed to the public.

Upon motion duly made and seconded the Committee went into closed session at 10:21 p.m.

Personnel matters were discussed.  The Girl Scout Board of Adjustment application was discussed. 

Upon motion duly made and seconded the Committee returned to open session at 10:57 p.m.

R2004-123

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, SUPPORTING STATE HOUSE COMMISSION APPLICATION TO THE NJDEP GREEN ACRES PROGRAM FOR DIVERSION FROM RECREATION USE

            WHEREAS, Lot 6 IN block 116 is part of the India Brook Park which is encumbered with restrictions against disposal or diversion from recreation and conservation uses under the New Jersey Department of Environmental Protection Green Acres Program; and

            WHEREAS, in conjunction with the proposed use of rental units for members of the Township’s emergency services personnel, it is necessary to submit a Resolution affirming the Township of Mendham’s support of the application to the State House Commission for the diversion of a portion of Lot 6 in Block 116; and

            WHEREAS, the area to be diverted comprises 3520 s.f. of building area and has been valued at $200,000; and

            WHEREAS, the Township of Mendham agrees to compensate for the diversion by a $200,000 financial contribution to the Mendham Township Open Space Trust Fund.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, as follows:

            The Township of Mendham supports the application for the India Brook Park Emergency Service Personnel Rental Units to the State House Commission.

Mr. D’Emidio made a motion to adopt R2004-123; Mr. Krieg seconded the motion.

ROLL CALL – All present voted YES.

R2004-124

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, APPOINTING EMPLOYEE TO THE DEPARTMENT OF PUBLIC WORKS

            WHEREAS, a need has arisen for a full-time employee in the Department of Public Works; and

            WHEREAS, Steven Dipple has been employed in a part-time position in the Department of Public Works since April 13, 2004; and

           

            WHEREAS, it is the recommendation of the Superintendent of the Department of Public Works that Steven Dipple be appointed as a full-time employee in the Department of Public Work

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, in the County of Morris, New Jersey, that Steven Dipple be appointed as a full-time employee in the Department of Public Works at an annual salary of $27,040.00 effective October 27, 2004.

Mr. Krieg made a motion to adopt R2004-124; Mr. Phelan seconded the motion.

ROLL CALL – All present voted YES.

R2004-125

RESOLUTION OF THE TOWNSHIP COMMITTEE OF THE TOWNSHIP OF MENDHAM, IN THE COUNTY OF MORRIS, NEW JERSEY, APPOINTING TEMPORARY EMPLOYEE IN THE OFFICE OF THE BOROUGH AND TOWNSHIP OF MENDHAM MUNICIPAL COURT

            WHEREAS, the Deputy Court Administrator for the Borough and Township of Mendham Municipal Court has resigned effective October 29, 2004; and

            WHEREAS, that resignation has created the need for a temporary employee to aid the Court Administrator until the Deputy Court Administrator position is filled; and

            WHEREAS, Ingrid O’Connor, an experienced Deputy Court Administrator, has agreed to fill in on a temporary basis for 15 hours per week.

            NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Mendham, that Ingrid O’Connor be hired for 15 hours per week at an hourly rate of $17.00, effective October 27, 2004.

Mr. Krieg made a motion to adopt R2004-125; Mr. Phelan seconded the motion.

ROLL CALL – All present voted YES.

With no additional matters to come before the Committee, upon motion duly made and seconded the meeting adjourned at 11:10 p.m.
