MENDHAM TOWNSHIP PLANNING BOARD

WORKSHOP MEETING

DECEMBER 6, 2004

Chairman Giordano called the meeting of the Mendham Township Planning Board to order at 7:35 p.m

ROLL CALL:

ADEQUATE NOTICE of this meeting of the Mendham Township Planning Board was given as follows:  Notice was sent to the DAILY RECORD and the OBSERVER TRIBUNE on January 8, 2004 .  Notice was posted on the Bulletin Board in the Township Hall in Brookside , New Jersey on January 8, 2004 , and Notice was filed with the Township Clerk on January 8, 2004 .

Chairman Giordano referred to the proposed 2005 Planning Board Meeting dates which were provided as information and to be moved at the Reorganization Meeting in January 2005.

ORDINANCE 22-2004

Chairman Giordano stated Ordinance 22-2004 is before the Planning Board for review and is on the agenda for the next Township Committee Meeting.  He said the ordinance has been significantly modified since the Planning Board last reviewed it.

Mayor Pierson said a presentation by Mr. Timpson and Mr. Nadaskay, who are in attendance tonight, was made to the Township Committee, and the governing body voted to approve it on first reading and to forward it to the Planning Board for final review.  He further said the Township Committee is seeking the Planning Board’s input prior to voting on the ordinance.

Mr. Falcon noted that this ordinance was referred to the Planning Board under the MLUL to review it for consistency with the Master Plan.  He said the merits of the matter are now in the hands of the Township Committee, and there will be a full public hearing before the governing body.  Mr. Falcon stated that the Planning Board has been deeply involved in this ordinance, and the narrow purpose of the statute tonight is to determine whether the ordinance introduced by the governing body is in accordance with the Master Plan.

Chairman Giordano started the discussion and noted if there was any assistance needed, questions could be addressed to Mr. Nadaskay and Mr. Timpson.

A lengthy and full discussion ensued about the application process, checklist items, completeness, timetables, and definitions and there were numerous suggestions made by the Planning Board.  Mr. Timpson stated that he was reluctant to make changes to the definitions because they have been tested in court and have been accepted.  Mr. Nadaskay said he didn’t think they could be any more specific than actually listing all the buildings and structures, about 10-1/2 percent in the Township, that are being discussed and including it in the ordinance as Schedule A.  He said the Historic Preservation Committee has made a lot of the Planning Board’s recommendations, simplified the ordinance, and taken away the onerous part of the demolition portion.

Chairman Giordano referred to a memo from Mrs. Link listing items of inconsistency

to be considered and provided Mr. Nadaskay with a copy. 

Mr. Falcon noted that the extent of the comments that are going to be suggested by the Planning Board to the governing body could throw this into a change of substance and the governing body will not be able to carry this ordinance over to next year.  Mayor Pierson suggested Mr. Falcon summarizing the items discussed and have the Planning Board provide their suggested changes to the Township Committee for consideration and Mr. Clapp would have an opportunity to determine if the changes are major or not. 

Further discussion then ensued regarding noticing, regulations, demolition and appeals.  Mayor Pierson respectfully suggested that if the Planning Board believes that this ordinance is within the realm of the Master Plan, a vote should be taken on that issue.  He said the commentary is always welcome by the governing body, and to the degree it could be spelled out in the format of a proposal to the ordinance would be very helpful.  Mayor Pierson noted that the regulations issue pointed out by Mr.Tolley may not be able to be done by the end of year, and there were a lot of good points for strengthening the ordinance discussed tonight. 

Chairman Giordano noted that the mayor has made a motion, and Mr. Falcon referred everyone to the draft resolution he provided regarding Ordinance 22-2004 and its consistency with the Master Plan. Mr. Falcon noted that the motion is for the simple finding that the Planning Board finds no inconsistency between the Master Plan and the ordinance, and the Planning Board will communicate with the governing body the four suggested items:

1)       the notice that goes to property owners is a form provided by the HPAC;

2)       the governing body consider whether or not to have the HPAC report a completeness item or agency report;

3)       25-5.2 to be considered for amendment to provide both a Section A and Section B and one for review by the Board and one for approval of demolition permit; and

4)       the governing body describing the administrative process to be used at a hearing in connection with the delay of demolition.

Mr. Falcon offered to draft the memo for the Planning Board to send to the Township Committee.

Mr. Mountain seconded Mayor Pierson’s motion; roll call vote – Mountain-yes, Pierson-yes, Giordano-yes, Tolley-no, D’Emidio-yes, and Majorossy-no.

CORRESPONDENCE
Chairman Giordano referred to the correspondence and there were no comments.

ADOURN

There being no further business, a motion was made to adjourn the meeting.  The motion was seconded, all aye, and the meeting was adjourned at 9:05 p.m.
